株式会社ニューズドテック（旧：株式会社携帯市場）（以下、「私達」といいます。）は、スマホカルテ（以下、「本アプリ」といいます。）のユーザー（「以下、「あなた」といいます。）との関係での、プライバシーポリシーを、以下のとおり定めます。
１．情報取得者
本アプリに関しあなたの情報を直接取得する者は、以下のとおりです。

２．取得情報、利用目的、取得方法
（ａ）本アプリは、スマートフォンの部品やシステム等の検査をし、スマートフォンの故障や消耗やこれらの生じる可能性等をあなたに通知し、また、かかる検査結果に基づき、スマートフォンの買取、販売等のサービスをあなたに提供するためのものです。この目的のため、私達は、あなたから、以下の情報を取得、貯蔵するとともに、スマートフォンメーカー、通信事業者等に提供し、また、共同利用される可能性があります。これに伴い、あなたから取得した情報が、スマートフォンメーカー、通信会社等の第三者に提供され、また、共同利用される可能性があります。
また、日本、インドにおいて、あなたから取得した情報が処理され、貯蔵、または共同利用される可能性があります。
（１）あなたが入力した内容が私達に自動的に送信されることにより取得される情報：氏名、電子メールアドレス、注文コード（注文番号）、IMEI（製造番号）、パスワード、居住都道府県、生年月日
（２）本アプリをあなたが使用することにより情報が私達に自動的に送信されることにより取得される情報：端末及び契約者に固有のＩＤ（ＯＳが生成するＩＤ、独自端末識別番号（ＵＤＩＤ）、加入者識別ＩＤ（ＩＭＳＩ）、ＩＣカード識別番号（ＩＣＣＩＤ）、ＭＡＣアドレス、ＩＰアドレス等）、スマートフォンを構成する部品を識別し及びその状態を示す情報、クッキー、本アプリの利用履歴、スマートフォンメーカー、モデル、ＯＳ、ＯＳのバージョン、通信会社、位置情報等
（ｂ）（ａ）（１）に記載された情報を、私達は、本アプリ内のサービス（故障予測診断およびバッテリー予測診断等）の提供、本サービスに関する利用者からのお問い合わせへの回答（本人確認を行うことを含む）、本人確認、本アプリに関する通知、私達の別サービスに関する通知、利用規約やプライバシーポリシーやそれらの変更に関する通知、本サービスに関するアンケート・取材等のご協力依頼や各種イベントへのご参加をお願いし、又はその結果などをご報告するため、本サービスの利用履歴等を調査・分析し、その結果を本サービスの改良・開発や通知の配信、その他私達のマーケティングに利用するため、あなたとのコミュニケーション、利用規約やプライバシーポリシーに違反する行為への対応のために用います。
（ｃ）（ａ）（２）に記載された情報を、私達は、本アプリ内のサービス（故障予測診断およびバッテリー予測診断および情報提供等）の提供、本アプリに関連するサービスの改善、新商品や新サービスの開発のために用います。
（ｄ）（ａ）（２）に記載された情報を、私達は、スマートフォンまたはスマートフォンを構成する部品の故障や消耗の予測、故障の防止、長寿命化等の研究のため、国立研究開発法人産業技術総合研究所に提供し、また、共同利用します。
（ｅ）（ａ）に記載された情報を、私達は、上記各利用目的に付随しまたは関連する利用目的のために用います。
３．同意取得の方法
あなたのプライバシーに関する同意の取得は、本アプリのインストール時または起動時に行います。
４．情報取得の終了
あなたからの２条に記載した情報の取得が本アプリの動作の前提となるので、本アプリをアンインストールすることにより、あなたの情報の取得が終了します。
５．情報の第三者提供、共同利用、外国にいる第三者提供
私達は、２条（ａ）及び２条（ｄ）に記載したとおり、あなたから取得した情報を第三者提供し、共同利用し、また、外国にいる第三者に提供することがあります。これらの場合の情報の管理責任は私達が負います。
また、生命、身体もしくは財産の保護のため、または、公衆衛生の向上もしくは児童の健全な育成の推進のために必要がある場合を含む、個人情報保護法その他の法令により、あなたの同意を得ずして情報の第三者提供が認められている場合、あなたの同意を得ずに情報の第三者提供や外国にいる第三者に提供することがありえます。
６．個人情報の取扱いの委託
私達は、利用目的の達成に必要な範囲内において、個人情報の取扱いの全部又は一部を委託する場合があります。この場合、私達は、委託先としての適格性を十分審査するとともに、契約にあたって守秘義務に関する事項等を定め、委託先に対する必要かつ適切な監督を行います。また、私達は、取得個人情報の全部又は一部を、個人情報保護法の定めに基づいて共同利用することがあります。
７．開示、訂正、利用停止等
あなたが私達に対して、個人情報保護法その他の法令に基づき、個人情報の開示、訂正、追加、削除、利用停止、抹消の請求をした場合は、個人情報保護法その他の法令の要件を満たし、かつ、個人情報保護法その他の法令に基づき私達がこれらの義務を負わない場合を除いては、あなたの本人確認を行った上で、これに応じます。
これらの請求を行う場合は、8条に記載されている問い合わせ窓口にご連絡ください。
また、個人情報の開示は原則として電子メールにより行います。

私達は、プライバシーポリシーの変更を行うことがあります。これに伴い、変更されたプライバシーポリシーへのあなたの同意を求めることがあります。

2. Collected information, Purpose of Use, Method of Collection
(a) This app is made for inspection of parts, system and so on of a smartphone, notification to you of the malfunction or exhaustion or the possibility of them of the smartphone, and provision to you of opportunities to sell, buy, or exchange smartphones
For this purpose, we collect information from you as follows, provide the information to smartphone makers, smartphone parts makers, smartphone carriers and so on, and jointly use the information with them. In this case, the information collected from you may be provided to or jointly used with foreign third parties who are foreign smartphone makers, smartphone parts makers, smartphone carriers and so on.
Information collected from you can be processed or stored in Japan, US, Canada, UK, Australia, New Zealand, India or Mongolia. So, in this case, the information may also be provided to or jointly used with foreign third parties.
(1) Information collected by input by you and automatic transmission of the information to us: name, phone number, email address, subscription number, order number,IMEI
(2) Information collected by use of this app by you and automatic transmission of the information to us: IDs peculiar to the smartphone and the subscriber of the smartphone (ID created by OS, Unique Device IDentifier, International Mobile Subscription Identity, International Mobile Equipment Identifier, MAC address, IP address and so on), information concerning the identification and the status of the parts of the smartphone, cookies, history of use of this app, smartphone maker, model, OS, version of OS, smartphone carrier and so on.
(b) We use information described in (a) (1) for identity verification, notice concerning this app, notice concerning term of service and privacy policy and amendment of them, communication with you and reaction to the violation of term of service or privacy policy.
(c) We use information described in (a) (2) for improvement of this app and the service related to this app and development of new products and services.
(d) We provide and jointly use information described in (a) (2) to and with National Institute of Advanced Industrial Science and Technology for the purpose of research of prediction of malfunction or exhaustion, prevention of malfunction, realization of longer life and so on of smartphones or the parts of smartphones.
(e) We use information described in (a) for the incidental or related purpose to the purposes stated above.
3. Procedure of Acquisition of Consent
We acquire your consent regarding your privacy right when you install or activate this app.
4. Termination of Collection of Information
Collection of information from you terminates when you uninstall this app, because collection of the information described in Article 2 is prerequisite to function this app.
5. Provision of Information to Third Party, Joint Use of Information, Provision of Information to Foreign Third Party
As stated in Article 2 (a) and 2 (b), we may provide or jointly use information collected from you to and with third parties, including third parties located in foreign countries. In this case, we are responsible for the management of the information.
We may also provide information collected from you to third parties, including third parties located in foreign countries, without consent of you, when personal information protection law or other law or regulation allows us to do so without consent of you, which may include the cases where provision of personal data is necessary for the protection of the life, body or property or for improving public health or promoting the sound growth of children.
6. Disclosure, Correction, Discontinuance and so on
When you request us to disclose, correct, add, delete, discontinue or erase your personal information, if your request meets the requirement provided for in personal information protection law or other law or regulation and unless we do not have obligation to do so according to personal information protection law or other law or regulation, after identity verification of you, we do so.
When you request these acts, please contact us by sending email to our email address stated in Article 7. Disclosure of information is processed by sending email to you in principle.
